The Evidence

 During the custodial interrogation of Marni Yang from 1-4-08 to 1-6-08the

LCMCTF discovered a weakness in Marni when they said her son Andrew had access to the missing 9mm gun. They told Marni that this gun’s ballistics matched the evidence recovered at the crime scene and at that time Marni asked for an attorney for her son Andrew.

In early February of 2009, LCMCTF discover the rental car Marni rented along with and instead of simply questioning her about the rental car they watch the video tape taken on October 4, 2007, from the Shell gas station on Osterman, and notice a small black car driving in the direction of Rhoni Reuter’s an hour prior to the murder. LCMCTF then devises an elaborate plan to arrest Marni Yang.

Step 1: .LCMCTF obtains a wiretap order on February 18, 2009.

Step 2: LCMCTF brings in people close to Marni in for questioning-- Christi

Paschen, Marni’s friend, Sal Devera, Marni’s boyfriend, and Andrew Yang

knowing Marni will begin to make calls to each of them after the questioning has taken place. They planned to commence questioning these individuals on 2-24- 2009 the day the wiretap began recording her calls. LCMCTF begin to focus on Christi Paschen as the only one who could possibly get Marni to talk.

Step 3: On 2-27-09 . LCMCTF detain Christi Paschen. They hold her

incommunicado for several days at the Marriot Hotel in Deerfield. Paschen is not allowed to leave, step outside, or even have her cell phone.

Step 4: LCMCTF wants Christi Paschen tell Marni at a meeting or on an

unrecorded line that the LCMCTF were going to arrest Andrew for the murder. Paschen is heard speaking with Yang on her landline on 2-28-09.

Step 5: At 11:33 Christi calls Marni on a wiretapped line and says:  

Christi “I mean I went over everything with this and that I could remember but they were on and on about this phone and about the car. I don’t what the hell that is. I don’t know so you think about it. I am too fucking tired to think about it.”

Marni “Alright, we will start making shit up”

Christi “Alright, whatever. I am going to bed.”

It was at this time that Marni decided to implement her plan. A plan she had been putting in place since she had sat with Andrew at the mental health hospital. Her plan was to take the case out of the hands of the LCMCTF who were destroying her children and get the case in front of the court. Marni’s plan was to confess to the murder to order to get in the courtroom. At this point Marni still had faith in the judicial system but had lost faith in the police.

Marni had spoken to a dear friend of the family, of the plan and even elaborated on the details of how she would confess to the murder using information she had been given by the LCMCTF, her children when they were questioned and what she had observed in the media. Marni had also discussed her plan with Christi Paschen multiple times.

On March 1, 2009, at 10:09 pm Christi calls Marni about meeting for ice cream at “their usual spot” Christi tells Marni that she is turning her phone off because the battery is low. This is because the LCMCTF still have not returned her cell phone to her. She was only given her phone when the LCMCTF wanted her to contact Marni.

At 10:48 pm Marni and Christi enter Denny’s and Marni sees the wire. Christi excuses herself to the bathroom where she hides the wire and says to her handlers from the LCMCTF ,“We may have trouble folks, a piece came out and was hanging down. I don’t know whether she saw it or not. Hopefully, she didn’t see the piece.”

Marni did see the wire hanging beneath Christi’s clothing and knew Christi was working with the LCMCTF. Marni had not gone to Denny’s to CONFESS to Christi Paschen, Marni had simply gone to Denny’s to speak to Christi to gather information about what the LCMCTF had told her. Marni wanted this information prior to going to the police station to present her false confession.

At Denny’s Marni makes a decision to implement her plan to get arrested in order to get the case into the hands of the court and her attorney. Marni follows Christi’s line of questioning and begins to answer her questions about the gun.

Marni fully expects to be arrested in Denny’s and is surprised when she is allowed to leave at 11:21pm.

On March 2, 2009, at 7:34 p.m. receives a call from Christi and agrees to meet again. This time Marni draws on everything she remembers about the crime. She has one goal and that is to be arrested.

Marni wanted to be arrested. That was her only goal. If she intentionally provided false details that could prevent her arrest.

Also, if Marni inserted wrong information to give herself an “out” then why didn’t she use these intentionally wrong facts at court? Why not have her attorney expand on each of them so she could win at her trial?

There is but one answer…Marni Yang was not knowing inserting wrong

information to provide herself with a way to beat a murder charge. Marni Yang did not know the details she provided were wrong until Larsen Forensic and Dr. Wecht began examining the evidence at the crime scene.
